Terms and Conditions

These Terms and Conditions (“T&Cs”) shall govern the access to and use of the designated parking slots for electric vehicle (EV) charging (the “Designated Parking Slot/s”) located within the parking area of select Starbucks stores of Rustan Coffee Corporation (RCOC).

By accessing and using any of the Designated Parking Slots, the EV owner or EV user (hereinafter referred to as the “User”) acknowledges that he/she has read and understood these T&Cs and agrees to be bound by them without qualification.

I. Eligibility and Access

  1. The Designated Parking Slots may be accessed and used by the User during store operating hours provided he is a customer of the applicable Starbucks store and is intending to use the EV charging facility (the “EV Charging Facility”). Store hours are subject to change without prior notice.
  2. The User must present the following to the Parking Attendant before the User may be allowed to use any vacant EV Charging Designated Parking Slot:
    1. Starbucks-validated parking ticket
    2. A current dated Starbucks Official Receipt representing purchase of at least P300.00
    3. Evro App
  3. Access and use of the Designated Parking Slots shall be on a first come first serve basis, exclusive to EVs, and subject to the terms, conditions, and limitations herein stated.
  4. EVs must be moved to a regular parking slot once charging is complete. Regular parking slots are subject to availability, standard parking guidelines, and applicable fees.
  5. Users are responsible for the vehicles and belongings and shall not leave valuables in their vehicles. RCOC shall not be responsible for any loss or damage to the vehicles or other properties found inside the vehicle, or to the person of the Users and his companion, including those arising from theft.

II. Parking and Fees

  1. Parking Fee for the use of the Designated Parking Slot shall be P300.00 per hour. Parking Fee for the first two (2) hours shall be waived upon presentment of the ticket and receipt mentioned in Section 2.a and 2.b above. Beyond the initial two (2) hours, the regular rate shall apply, with a fraction of an hour considered as one (1) hour.
  2. The Parking fees are separate from and independent of the charging fees imposed by the Evro App (the “Evro Charging Fees”) for the use of the EV Charging Facility.
  3. Users who access and use the Designated Parking Slots and/or use the EV Charging Facility, despite failure to present the ticket and receipt mentioned in Section 2.a and 2.b above, shall be charged P500.00 on top of the Parking Fee of P300.00 per hour, with a fraction of an hour considered as one (1) hour.
  4. EVs parked on the Designated Parking Slots but are not using the EV Charging Facility will be asked to be removed, and will be charged P1,000.00 penalty for non-compliance, on top of the hourly parking fees and fees mentioned in Sections II. 2 and II.3 above.
  5. EVs parked on the Designated Parking Slots and are done charging must be timely removed. If not removed despite the completion of charging or notice to remove, the User shall be charged P1,000.00 penalty for non-compliance, on top of the hourly parking fees and fees mentioned in Sections II. 2 and II.3 above.
  6. Vehicles which are not EVs but parked on Designated Parking Slots shall be charged P2,000.00, on top of the hourly parking fees and fees mentioned in Section II.3 above.
  7. Overnight parking is strictly prohibited and vehicles left overnight shall incur a ₱3,000 penalty, on top of the hourly parking fees and fees mentioned in Sections II. 2 and II.3 above.
  8. On top of the above charges, Users not found within the premises of the Starbucks store and who left their vehicles will be charged an additional P2,000.00.
  9. Lost parking tickets shall incur a penalty of P1,000.00 and shall be subject to presentation of ownership and identity documents such as but not limited to vehicle registration (Certificate of Registration with Official Receipt) and valid competent evidence of identity, on top of the hourly parking fees and fees mentioned in Sections II. 2 and II.3 above and other applicable fees and charges.
  10. Any vehicle found to be not compliant with these T&Cs may be subjected to towing, at the User’s expense, without prejudice to the payment of all charges and fees related thereto and for the use of the parking slots of RCOC. User waives any right to question such removal and charges in view of his/her violation of these T&Cs.
  11. A validated EV Parking Ticket serves as the official parking receipt.

III. EV Charging Facility

  1. The EV Charging Facility found in the Designated Parking Slots are owned, maintained, and operated by AC Mobility Holdings Incorporated (ACM) and are subject to the voluntary use by the Users. RCOC is not the owner or operator of the EV Charging Facility and of the Evro App, and as such, shall not in any way be responsible or liable for the operation, availability, maintenance, performance, use, or safety of the EV Charging Facility, the Evro App, or any of their respective components. By using the EV Charging Facility and/or the Evro App, the User acknowledges and confirms that he/she has knowledge of such ownership by ACM, non-ownership and liability by RCOC, and voluntariness of use and agrees with such matters without qualification.
  2. The use of the Charging Facility shall be governed by the specific terms and conditions imposed by ACM (insert link) and the Evro App (http://evro.ph/terms-and-conditions). By using the EV Charging Facility, the User acknowledges and confirms that he/she has accessed, read, and understood such terms and conditions and agrees to the said terms and conditions without qualification.
  3. Users are responsible for operating the EV and the EV Charging Facility safely and in accordance with ACM and Evro terms and conditions and in monitoring the same while parked at the Designated Parking Slot or using the EV Charging Facility, and agrees to indemnify and hold RCOC free and harmless for any claims, losses, or damages, whether to property or person, resulting from or related to their EV and their use of the EV Charging Facility, including non-compliance with procedure or recommended charging time. RCOC staff and personnel are not permitted to assist in using the EV Charging Facility or Evro App but may assist in reporting a matter to ACM.
  4. RCOC shall not be liable for any loss, damage, injury, or costs arising from the use or inability to use the EV Charging Facility or the Evro App or any their respective components, including those arising from equipment malfunction, power interruption, electrical issues, vehicle issues, or loss or damage to the EV, other property, or persons related to the use of the EV Charging Facility.

V. Enforcement and Updates

  1. RCOC may, at any time, restrict the use or access of the EV Charging Parking Slots for whatever reason it may deem appropriate.
  2. These T&Cs may be updated from time to time and without prior notice.
  3. These T&Cs shall be complemented or supplemented by any other parking ticket or guidelines, rules, regulations issued by RCOC.
  4. Violations of these T&Cs and guidelines, rules, and regulations entitles RCOC to seek recourse, including the towing of the non-complying vehicle.
